Recites that under the provisions of the ___ and 9th articles of the treaty concluded May 10, 1854 between the United States and the Delegates of the United Tribe of Shawnee Indians, certain members of said tribe became entitled out of the lands ceded by said treaty “if a single man” two hundred acres and if the head of a family a quantity equal to two hundred acres for each member of his or her family and to a patent therefor and whereas it appears from Reservation Book C, that there have been located and approved as the selection for Paschal Fish, the head of a family consisting of himself, Martha Fish, Obediah Fish, Udora Fish, Leander Fish and Mary Ann Fish, the following tracts of land, to wit:

The southeast Quarter of Section 8 containing 160 acres, the southeast quarter of the southwest quarter of Section 8, containing 40 acres, the Northeast Quarter of Section 10, containing 160 acres, the Southeast Quarter of the Northwest Quarter of Section 10 containing 40 acres, the Northeast Quarter of Southwest Quarter of Section 8, contains 40 acres, the East half of the Northwest Quarter of Section 8, containing 80 acres, the West half of the Northeast Quarter of Section 8, containing 80 acres, the Southeast Quarter of the southwest Quarter of Section 5, containing 40 acres, the South half of the Southeast Quarter of Section 5, containing 80 acres, the East half of the Northeast Quarter of Section 8containing 80 acres, the North half of the Southeast Quarter of Section 5, containing 80 acres, the East fractional half of Northeast fractional quarter of Section 5 containing 28.95 acres, the West fractional half of the Northeast fractional quarter of Section 5, containing 65.55 acres, the Northeast Quarter of the Southwest Quarter of Section 5, containing 40 acres, the Northeast quarter of the Northwest Quarter of Section 5, containing 39.86 acres, the Northwest Quarter of the Northwest Quarter of Section 5, containing 39.86 acres, and the South half of the Northwest Quarter of Section 5, containing 80 acres, all being situated in Township 13 South of Range 21 East of the 6 th P.M. in Kansas.

On February 4, 1860 , Paschal Fish sold for the “consideration” of $10,000, 774.50 acres in Township 13, south of Range 21, to Louis Pfeif and Charles Duerr, which was recorded in the Eudora Book B, page 5. The actual acreage was:
